If you do a limited number of conveyancing files each month, or simply don’t have the experienced conveyancing staff to support your real estate files, we can help you with that.
We work with your document generation program, logged in under an account you create for us. This allows us to use your precedents and account information. It also allows you to retain all work produced, to regenerate any documents you wish (from your own data), and to make amendments to documents at your own leisure.
Accordingly, we will ask you for:
- a login for your document generation program
- depending on your document generation program, we may require logins for peripheral services
- for the Advanced Service, logins for your due diligence and registration accounts
We provide two levels of conveyancing services. We also provide more tailored services on an hourly basis.
Standard Service
Our Standard Service provides you with the basic data entry and document generation required for a standard conveyancing file.
You provide us with:
- a copy of the real estate contract, any addenda or conveyance instruction sheets
- a copy of any lender instructions
- a completed intake form
- your instructions about any documents or assistance you require over and above the standard documents generally produced for the type of file for which you are getting support
Once you have provided us with this documentation, we will enter the data in your document generation program.
We will then provide you with an agreed upon series of documents, generated from data you have provided to us, and using your own document generation program, that will let you complete a standard conveyancing file, including:
- engagement letter
- due diligence:
- title insurance order form
- property insurance binder request form
- strata document requests
- mortgage payout requests
- financial documents, including
- trust reconciliation
- statement of adjustments
- authority to pay
- title registry documents for transactions in the:
- BC Land Title Office
- Manufactured Home Registry
- First Nations registries and ILRS
- lender documents, including:
- Conflict letters
- Order to Pay
- Request for Funds
- mortgage and security loan agreement documentation for registration
- Acknowledgement and Receipt of Mortgage terms
- reports to lender
- closing day documents, including:
- reports to lender, client and other side
- letters to realtors
You provide us with the following data and documentation:
- a copy of the real estate contract, any addenda or conveyance instruction sheets
- a copy of any lender instructions
- a completed intake form
- your instructions about any documents or assistance you require over and above the standard documents generally produced for the type of file for which you are getting support
You remain responsible for:
- sending all search requests prepared by us
- following up on all due diligence requests
- correspondence with lenders
- negotiating undertakings with the other side, lenders, realtors and any other parties
- registration of any necessary documents
- creation, retention and distribution of holdbacks
- paying out all trust funds
- following up with all payouts for receipts and registration documentation
This level of service is appropriate for standard conveyancing files such as:
- cash purchase
- purchase with standard lender
- clear title sale
- sale with one standard discharge
Advanced Service
Our Advanced Service is our most comprehensive service.
In addition to the services provided under our Standard Service package, you get:
- one round of revisions to documents at your instruction
- documents and modifications prepared at your instruction for more complicated transactions, such as:
- holdback language in undertakings letters
- documents which might be required for out of office signing appointments
- documents required for files involving multiple registry (LTSA+MHR/PPSA or ILRS)
- vendor-take-back or private mortgages
- deeds of gift or declarations of trust
- registration services
- follow up letters for holdbacks and payouts
Services we do not provide
We do not provide the following services:
- negotiating undertakings
- provision of legal advice to you or to your clients
- instructing you with respect to the legalities of the transaction
- holding or paying out trust funds
